Terms of Service – Signal Sounds Europe

These Terms of Service (hereinafter "Terms") govern the use of the website signalsounds.eu (and any related subdomains, hereinafter "Website") operated by Sound Of You Sp. z o.o., and the purchase of products through it. By placing an order, you confirm that you have read, understood, and agree to these Terms.

1. General Provisions and Seller Identification

  2. These Terms constitute the regulations for providing services electronically via the Website and define the rules for concluding sales contracts for products offered on the Website, their performance, and related rights and obligations of the parties.
  3. Any content published on the Website (including product descriptions, images, prices) does not constitute an offer within the meaning of the Polish Civil Code, but an invitation to conclude a contract.
  4. Polish law applies to contracts concluded through the Website. In matters not covered by these Terms, the provisions of the Polish Civil Code, the Act of 30 May 2014 on Consumer Rights (Dz.U. 2023 poz. 2759 as amended), and the Act of 18 July 2002 on Electronic Services (Dz.U. 2023 poz. 1230 as amended) shall apply.

2. Consumer Rights and Definitions

  1. Consumer means a natural person concluding a contract with the Seller directly related to their business or professional activity, where the content of that contract indicates that it is not of a professional nature for that person, arising in particular from the subject matter of their business activity, made available on the basis of the provisions on the Central Register and Information on Business Activity (so-called "entrepreneur on consumer rights").

  3. The Seller informs that in the case of Consumers, they have the right to withdraw from the contract within 30 days without giving a reason, subject to the exceptions specified in §6. Detailed rules are set out in §6 of these Terms.

3. Placing Orders and Concluding Contracts

  1. Orders can be placed:
  2. To place an order via the Website:
    a) add products to the cart,
    b) confirm the order by clicking "Buy and Pay",
    c) select the delivery method and payment method,
    d) provide billing and delivery details,
    e) accept these Terms and the Privacy Policy,
    f) confirm the order.
  3. The sales contract is concluded at the moment you receive the order confirmation email sent automatically by the Website. The confirmation email contains a summary of the order, including product details, price, delivery costs, and payment method.
  4. Orders placed on non-business days (holidays, weekends) are processed on the next business day. The Seller reserves the right to refuse or cancel an order if:
    a) the data provided raise reasonable doubts as to their truthfulness,
    b) there is a lack of payment within 5 business days from order confirmation,
    c) the products are unavailable despite reasonable efforts.

In case of cancellation after payment, the Seller will refund the amount within 14 days.

  1. Prices are binding as displayed on the Website at the time of order confirmation, including applicable VAT, unless there was an error in the data of the price provided in which case the Seller will contact the Consumer with the corrected price. The Seller reserves the right to change prices, introduce promotions, or withdraw products without prior notice.
  2. You may modify or cancel the order before shipment by contacting us via email.

4. Delivery

  1. Dispatch time: Products are dispatched by us to the courier within 48 hours (normally much sooner) from the moment the order is placed (for orders placed and paid during business hours). Orders placed after business hours, on weekends, or holidays are dispatched on the next business day.
  2. Total delivery time to the Buyer's address depends on the courier's service selected during order placement and the destination country. Estimated delivery times are displayed on product pages and during checkout.
  3. Orders are dispatched via courier companies selected by the Buyer or recommended by the Seller. Delivery costs are displayed during order placement and included in the total price.
  4. Risk of loss or damage to goods passes to the Buyer upon handover to the carrier (dispatch from our warehouse). The Seller is not responsible for delays, loss, or damage caused by the carrier, provided the delivery address was provided correctly. Incorrect or incomplete address details are the Buyer's sole responsibility.
  5. The Seller sends the purchase confirmation (invoice/receipt) and tracking information (if available) to the email address provided in the order.

5. Payment Methods

  1. Available payment methods:

    • Bank transfer (EUR): PL 73 1050 1025 1000 0090 8557 7204, BIC/SWIFT: INGBPLPW
    • Credit/debit card, instant transfer, PayPal via PayU (PLN/EUR).
  2. Payment term: 5 business days from order confirmation. Failure to pay results in order cancellation.
  3. For international deliveries, the Buyer bears all additional charges (customs duties, taxes, fees) imposed by the destination country.
  4. Refunds are made using the original payment method within 14 days.

6. Right of Withdrawal and Money-Back Guarantee (for Consumers)

  1. Statutory right of withdrawal: You have the right to withdraw from the contract within 14 days from the date of receiving the goods, without giving any reason.

To withdraw, send a statement (e.g. by email to info@signalsounds.eu) before the deadline.

Return the goods immediately, but no later than 14 days from the withdrawal statement, to:
Sound Of You Sp. z o.o., ul. Staniewicka 14A/16, 03-310 Warsaw, Poland.

Goods must be unused, complete, in original packaging.

The Seller refunds all payments received (including standard delivery costs) within 14 days from receiving the withdrawal notice, using the original payment method. The Seller may withhold refund until receiving the returned goods.

You bear the cost of return shipping. We do not accept COD returns.

  1. Voluntary 30-Day Money-Back Guarantee: Additionally, we offer a 30-day Money-Back Guarantee for all products (extending beyond the statutory 14-day withdrawal period).
    • Within 30 days from delivery, you may return any product for a full refund (including original shipping costs), even if it shows minimal signs of use for testing.
    • Contact us via email to initiate the return.
    • This guarantee does not apply to used, damaged, or incomplete products beyond reasonable testing, or if the return packaging is inadequate.
    • The guarantee is voluntary and does not limit your statutory rights.

7. Complaints and Warranty

  1. The Seller is liable for non-conformity of goods with the contract under the rules of statutory warranty – 2 years for Consumers from the date of delivery (art. 556 et seq. of the Civil Code).

For non-Consumers, liability is limited to the terms of the Civil Code.

  1. To file a complaint:
    a) send an email with description of the defect before returning goods,
    b) complete the Complaint Form (available on the Website),
    c) send the goods to the address in §6.1.

Shipping costs are borne by the Buyer.

  1. The Seller responds within 14 days from receiving the goods and complaint. If no response within 14 days, the complaint is considered accepted. Possible remedies: repair, replacement, price reduction, or contract termination (with refund).
  2. Complaints due to monitor settings (e.g. colour differences) are not accepted.
  3. Extended Warranty: We offer a voluntary 3-year warranty on all products for orders placed on or after 1 April 2026 completely free of charge.
    • Covers manufacturing defects under normal use.
    • Does not cover damage from misuse, accidents, modifications, or normal wear and tear.
    • Details, procedure, and exclusions are provided in the warranty card accompanying the product.
    • This warranty does not exclude or limit your statutory warranty rights.

8. Intellectual Property

All content on the Website (product names, descriptions, images, trademarks, logos) is protected by intellectual property law. Unauthorised use, copying, or distribution is prohibited.

9. Cookies and Privacy

  1. The Website uses cookies as described in our Privacy Policy. By using the Website, you consent to their use, unless you change your browser settings.
  2. Detailed rules for processing personal data are set out in our Privacy Policy.

10. Liability Limitations

  1. The Seller is not liable for:
    a) delays or damages caused by carriers,
    b) indirect losses, lost profits, or consequential damages,
    c) force majeure events.
  2. Total liability is limited to the value of the order.

11. Final Provisions

  1. The Seller reserves the right to amend these Terms. Amendments take effect 14 days after publication on the Website. Continued use of the Website constitutes acceptance.
  2. If any provision is invalid, the remaining provisions remain in force.
  3. In matters not covered, Polish law and mandatory EU consumer protection provisions apply. Disputes with Consumers shall be resolved by Polish courts competent for the Seller's registered office. Consumers may also use out-of-court dispute resolution (e.g. via the EU ODR platform: https://ec.europa.eu/odr).
